Siprut PC files lawsuit against manufacturer of dangerous American Airlines uniforms

Siprut PC has filed a class action against Twin Hill Acquisition Inc., the manufacturer of new American Airlines uniforms that were introduced to approximately 70,000 American Airlines employees in September 2016. Since the mandatory introduction of new uniforms into their workplace, thus far over 4,300 American Airlines flight attendants and pilots have experienced and reported a cascade of debilitating symptoms ranging from rashes, respiratory problems, fatigue, headaches, vertigo, endocrine problems and various autoimmune problems. The problems are so severe for some that even wearing alternative uniforms is not sufficient; working with other employees who are wearing the new uniforms in the closed airplane environment continues to cause problems.

The lawsuit seeks an injunction ordering Twin Hill to stop selling the uniforms as well as issuing a recall and the creation of a medical monitoring fund to pay for all future medical expenses required to examine and diagnose those who now or in the future may experience symptoms. It also seeks personal injury damages on behalf of the named Plaintiffs, Thor Zurbriggen and Dena Catan, American Airlines flight attendants.

This lawsuit is part of a two-step process that also involves pursuing claims against American Airlines in arbitration pursuant to federal law. For a copy of the complaint filed by Siprut PC, click here.

Baby Wipes Settlement Receives Preliminary Approval
The Eastern District of New York has issued preliminary approval of a class settlement resolving the long-running “Baby Wipes” litigation in which Siprut PC is co-Lead Class Counsel. The litigation, first filed in 2014, relates to millions of contaminated baby wipes manufactured by Nutek and sold to consumers nationwide. The settlement provides compensation for personal injuries – babies and families physically injured by the contaminated wipes – and also economic damages for consumers. Siprut PC defeats King.com’s motion to dismiss Candy Crush lawsuit
The federal district court in the Northern District of Illinois has denied King.com’s motion to dismiss Siprut PC’s class action over the popular Candy Crush app. Siprut’s lawsuit alleges that player lives, have an economic value and disappeared without justification from players’ accounts. Siprut PC obtains reversal on appeal after trial court’s mootness dismissal
The Illinois Appellate Court recently ruled in favor of Siprut PC’s client in holding that the defendant’s tender of relief did not moot the plaintiff’s claim for damages. The Court noted that Siprut’s legal theory was consistent with subsequent rulings from both the U.S. Supreme Court and Illinois Supreme Court, which found that unaccepted offers of settlement could not force the dismissal of class actions, regardless of whether a class action motion had been filed. Richard Miller authors three chapters in 2017 edition of Civil Discovery Practice
Richard L. Miller II, a partner at Siprut PC, authored three chapters in the 2017 edition of Civil Discovery Practice, published by the Illinois Institute for Continuing Legal Education (IICLE). Siprut PC settles glucosamine class action for $4.5 Million
Siprut PC has settled its class action against nutritional supplement developer Direct Digital, the maker of the Instaflex glucosamine product. The $4.5 million deal settles Siprut PC’s class action over claims that Direct Digital's joint health supplements aren’t clinically proven and don’t work as advertised. Siprut PC lawsuit against Survivors Network of Those Abused by Priests featured in Chicago Sun-Times
Siprut PC brought a retaliatory discharge claim on behalf of their client against Survivors Network of those Abused by Priests, or SNAP, a non-profit organization which represents itself to be a self-help network for survivors of sexual abuse by the clergy. The suit alleges that SNAP did little in terms of providing support services to survivors beyond referring them to attorneys, for which SNAP received kickbacks in the form of “donations,” and that Siprut PC’s client was discharged in retaliation for confronting her superiors regarding those activities. Siprut PC defeats motion to dismiss based on Spokeo in TCPA case
Siprut PC has defeated a motion to dismiss in one of the firm’s TCPA class actions, in which the defendant argued that the plaintiff lacked Article III standing under the U.S. Supreme Court’s decision in Spokeo, Inc. v. Siprut PC partners Joseph Siprut, Todd McLawhorn, Richard Miller, and Bruce Howard were all named “Leading Lawyers” in a statewide survey of attorneys asked to name the “top lawyers within their respective regions and/or area(s) of law.” The Leading Lawyers methodology further provides: “Only those lawyers who are most often recommended, and later approved by our Advisory Board, are selected as Leading Lawyers. We limit the total number of Leading Lawyers in a state to less than five percent of all lawyers licensed to practice law in that state.” Additionally, Siprut PC attorney Richard Wilson was named an “Emerging Lawyer,” limited to attorneys under the age of 40. Siprut PC achieves landmark victory in the Seventh Circuit
The Seventh Circuit Court of Appeals has revived a data breach class action lawsuit filed by Siprut PC against PF Chang’s. The Court reversed the trial court’s order granting PF Chang’s motion to dismiss on Article III standing grounds. Joseph Siprut argued the case before the Seventh Circuit. Chicago Tribune profiles Siprut PC’s lawsuit against the Village of Winnetka over stormwater utility fees
Siprut PC filed an action against the Village of Winnetka to curb the improper use of Winnetka’s taxing authority. In 2014 Winnetka chose to fund a $42 million stormwater project through a utility fee that is in reality a disguised property tax. Rather than raising property taxes, Winnetka elected to fund its stormwater project (which Winnetka’s residents rejected in a referendum) by charging mandatory utility fees of several hundred dollars annually. Under Illinois law, capital improvements such as the stormwater project’s eight-mile long tunnel must be funded via property taxes, not through arbitrary and non-measured utility fees. The lawsuit seeks to stop Winnetka from funding the project in this manner, and to recoup the amounts Winnetka has improperly collected from its residents. To read the Tribune article, click here. Siprut PC defeats IBM’s motion to dismiss in Homeland Security whistleblower lawsuit
Siprut PC has prevailed on IBM’s motion to dismiss the firm’s whistleblower action alleging that IBM, in a conspiracy involving Cook County government insiders and others, defrauded County, state and federal governments of millions in connection with a failed Homeland Security project. Siprut PC defeats Sony’s motion to compel infringement contentions in patent litigation
After serving initial infringement contentions in a patent lawsuit brought against Sony on behalf of an inventor,Sony moved to compel more particular infringement contentions, requesting that Siprut PC's client point more particularly to how the Sony Entertainment Network service infringes the inventor’s patent. The Court rejected Sony’s argument and ruled in favor of Siprut PC’s client, holding: "The Court does not find anything in the local rules or in the case law that suggests that a plaintiff patentee bears the burden of identifying what the accused instrumentality does not do, as Sony requests." (Emphasis in original.) This important decision marks the limit on how specific a patent plaintiff must be making infringement contentions before having obtained discovery from the defendant. To view the Court’s Order, click here.

Siprut PC has filed the first-ever class action against a state high school association related to concussions in football, the express goal of which is to change and improve mandatory concussion protocols at the high school level. Siprut PC prevails at Eleventh Circuit Court of Appeals in landmark class action decision
Siprut PC has successfully appealed the dismissal of a class action raising the issue of whether an individual settlement proposal purporting to offer full relief can moot the plaintiff’s claims, even if the offer is rejected, and even if the lawsuit is a class action. Joseph Siprut argued the case before the Eleventh Circuit and was lead counsel on appeal. The Eleventh Circuit reversed the district court and reinstated the case, which now makes an important contribution to this body of law. To read the opinion, click here. Joseph Siprut appointed co-lead counsel in NCAA Concussion Litigation MDL
Joseph Siprut was appointed as co-lead counsel in the NCAA Concussion Litigation, along with Steve Berman of Hagens Berman, by the United States District Court for the Northern District of Illinois. Siprut PC filed the first class action lawsuit against the NCAA on behalf of student-athletes in 2011, and has prosecuted the case since that time. After more lawsuits were filed against the NCAA in recent months, the cases were consolidated and sent back to Chicago by the MDL Panel. Judge John Lee then re-appointed Siprut as co-lead counsel for the Class.

Siprut PC reaches settlement with Energizer valued at $200 million
The United States District Court for the Northern District of Illinois has preliminarily approved a settlement achieved by Siprut PC valued at $200 million. Siprut PC filed a nationwide class action after reports in 2012 that people were being set on fire after using Ultra Mist and Banana Boat sunscreen products, which was traced to a defective nozzle that caused too much product to dispense. The firm filed suit on behalf of all consumers who purchased the defective products. An article about the settlement is available here.

Siprut PC brings class action against Ford Motor Co. related to sudden acceleration in Ford cars
Siprut PC, along with a team of some of the nation's top lawyers and law firms, recently filed a class action against Ford Motor Co. over Ford's documented sudden acceleration problems. The lawsuit claims that Ford's electronic throttle system can take control of the accelerator in certain model vehicles and leave drivers unable to stop the vehicle. The lawsuit further alleges that Ford added a brake override system in its North American cars in 2010, but failed to include the override in older-model cars. Siprut PC defeats United Airlines' motion to dismiss class action over reduced frequent flier benefits
Siprut PC has defeated United Airlines' motion to dismiss the Firm's class action lawsuit over reduced frequent flier benefits. The suit alleges that on March 3, 2012, United launched a new frequent flyer program that drastically reduced and devalued the benefits for its Premier-level frequent flier members. Importantly, however, the lawsuit alleges that United has refused to honor the benefits that Premier Members had already earned in the preceding calendar year — thus breaching its contracts with those members. Siprut PC files nationwide class action against Apple over shoddy retina display screens
Siprut PC has sued Apple Inc. in a lawsuit that accuses the company of tricking consumers into paying premium prices for MacBook Pro computers with shoddy retina display screens manufactured by LG Corp. Although Apple advertises the MacBook's liquid crystal display screens as the best of its kind, some of the computers contain LG screens that suffer from brightness, color and image display flaws while others feature better screens made by Samsung Corp. The lawsuit further alleges the LG screens fail to live up to Apple's marketing claims, and consumers have no way to tell whether a MacBook's screen is made by LG or Samsung until after they purchase the product. Siprut PC has filed suit against Freedom Mortgage Corp., alleging the lender discriminates against expectant and new mothers by refusing loans to any applicant with plans to go on maternity leave, regardless of changes to net income. The lawsuit further claims that Freedom's policy "penalizes" mothers for having children and taking maternity leave, which violates the Federal Housing Act and the Federal Equal Credit Opportunity Act. Joseph Siprut was quoted by Law360 on the lawsuit: "Expectant mothers face enough challenges as it is. They should not have to contend with the additional challenge of lenders rejecting loan applications based solely on maternity leave, even though their actual income is unchanged. . . . Siprut PC reaches settlement with Southwest Airlines valued up to
$58 million

Siprut PC has secured a settlement with Southwest Airlines in the firm’s long-standing nationwide class action against Southwest Airlines over Southwest's decision to stop accepting Business Select drink vouchers in 2010. The lawsuit alleged that  Southwest breached a contract with consumers when Southwest declared in August 2010 that it would no longer accept Business Select vouchers without a printed expiration date, and retroactively voided all previously issued vouchers. The settlement constitutes a complete and total victory for the Class, as Class members are permitted to receive replacement vouchers for each voucher they were previously issued and never redeemed. Given the number of unredeemed vouchers in circulation when Southwest began refusing to honor them, the settlement fund necessary to honor all claims is between $29 million and $58 million. The settlement also requires Southwest to print clear and conspicuous expiration dates on future vouchers, and to honor those dates. Joseph Siprut was asked by the Chicago Daily Law Bulletin to provide a perspective representing the plaintiffs' class action bar on new jury research by Defense Research Institute (DRI), the "Voice of the Defense Bar." DRI's research states that 58 percent of the respondents expressed confidence that the civil justice system produces fair results, but a significant percentage lack confidence in the system. The poll also measured attitudes toward class action litigation, with results suggesting 38 percent of American adults have been invited to participate in class-action cases, and of that amount, 15 percent have done so. Siprut PC has brought class action lawsuits against virtually all major operators in the cable industry, including Comcast, DirecTV, Time Warner, and RCN Cable, over violations of the Cable Policy Protection Act. Siprut PC brings lawsuit to enjoin the sale of baby crib bumpers
Siprut PC has filed a class action lawsuit against Crown Crafts over the marketing and sale of Crown Craft crib bumper products. The lawsuit alleges that instead of improving safety, crib bumpers, or "bumper pads," put children at greater risk for suffocation or crib death. Major children's safety organizations like the American Academy of Pediatrics have advised parents to remove bumper pads from baby cribs primarily because of the suffocation risk. Infant bedding sales exceed $50 million per year – a number that includes over 200,000 crib bumpers, according to the Juvenile Products Manufacturers Association (JPMA). The lawsuit claims that sales remain high because companies like Crown Crafts perpetuate the falsehood that crib bumpers eliminate risk of injury, when the opposite is true.

Siprut PC defeats Southwest Airlines' attempt to stay litigation
Siprut PC has overcome Southwest's attempt to stay or dismiss the firm's nationwide class action based on Southwest's termination of drink vouchers – previously issued to consumers with the purchase of airline tickets. The court held that some of the claims asserted against Southwest were preempted by federal aviation law, but that the core breach of contract claim could proceed. The court also rejected Southwest's argument that the case should be stayed pending resolution of separate litigation filed against Southwest. Siprut PC has filed suit against Google over its now-defunct Google Tags service, a marketing program that allowed business owners to place a yellow tag containing photos and other special content next to a Google Places listing.   The lawsuit alleges that Google charged users for a supposedly free trial period and held onto credit card information long after the service was shuttered, in violation of California law.  The case was profiled by Law360, available here.  To view a copy of the Complaint, click here.

Siprut PC files nationwide class action against Southwest Airlines over terminated drink tickets
Siprut PC has filed a class action lawsuit against Southwest Airlines over cancelled drink tickets. The suit alleges that Southwest, the United States’ largest airline, has long incorporated drink vouchers in many of its daily flight offerings.  At the time Southwest issued the Vouchers as part of these purchase transactions, they had no expiration dates.  Southwest subsequently decreed that it would no longer honor Vouchers still in circulation.  In so doing, the lawsuit alleges, Southwest breached its contracts with consumers.  To view the lawsuit, click here. Siprut PC appointed co-lead counsel in nationwide concussion litigation against the NCAA
Siprut PC has been appointed co-lead interim class counsel in the nationwide class action against the NCAA on behalf of current and former collegiate football players, along with the law firm of Hagens Berman, which also sued the NCAA. Siprut PC files whistleblower claims under Illinois False Claims Act on behalf of Cook County
Siprut PC has filed a lawsuit under the Illinois False Claims Act on behalf of Cook County against Sav-Rx, which has contracted with the Cook County Health Bureau for the past five years to fill mail order prescriptions and prescription refills.  The suit alleges that Sav-Rx charged the Health Bureau for prescriptions that Sav-Rx failed to fill, thus resulting in millions of dollars in overbilling.  To view the lawsuit, click here.

Siprut PC has filed a class action lawsuit against the NCAA on behalf of all NCAA football players that have suffered concussions or other head injuries. The suit alleges that the NCAA has failed to take meaningful steps to prevent its student-athletes from sustaining concussions and has ignored studies showing that repeated concussions are linked to early-onset dementia and Alzheimer's disease, depression, and lowered cognitive abilities, among other debilitating symptoms. FEBRUARY 2011

Settlement in lawsuit against the American Medical Association
Siprut PC founder Joseph Siprut secured a settlement on behalf of his clients, Angela Wonsey and China Travis, in their lawsuit against the American Medical Association.  Siprut represented Wonsey and Travis on a pro bono basis.  The lawsuit alleged that when China was 10 years old, she booked a modeling assignment for the AMA.  The AMA later featured China in a national media campaign aimed at motivating politicians to tackle the issue of Americans without health insurance.  According to the lawsuit, the campaign falsely represented that China – referred to in the ads as “Toya” – has a “severe” problem but her parents “can’t afford health insurance.”  The case settled under confidential terms. Victory against the State of Illinois in Grant Funds Dispute
Joseph Siprut scored a victory on behalf of his client, Spirit Soa, against the State of Illinois in Cook County trial court.  In 2000, Spirit Soa received a significant grant from the State to further its mission of mentoring at-risk, inner-city youth.  Years later, the State sought to reclaim those grant funds and procured a default judgment against Spirit Soa at the administrative level. Siprut challenged the administrative judgment in civil court.  Despite extremely limited judicial review of default judgments, Siprut convinced the Court to toss out the State’s administrative judgment, and remanded the case back to the administrative level for a hearing on the merits.
